Yes. Personal (civil) liability coverage is included in your home insurance policy.

What does personal liability coverage protect me against?

Personal liability insurance protects you if, in your private life, you accidentally cause bodily injury or material damage to third parties and you are legally required to compensate them. This could include situations such as:

  • Water damage to a neighbour’s property caused by a leak from your home.

  • An accident involving a visitor who is injured inside your home.

  • Damage caused by you or a covered household member to someone else’s property.

The insurer covers compensation payments, legal defence costs and related expenses, up to a maximum limit of €300,000.

Who is covered by the personal liability guarantee?

Personal liability cover applies to:

  • The policyholder.

  • The insured person, anyone covered by the policy and entitled to benefits if a claim is made.

  • Household members living permanently in the insured home (such as your spouse, partner, or dependent family members), provided there is no commercial or professional relationship.

Where does personal liability coverage apply?

  • Personal liability is generally valid for claims within the European Union, as long as they are handled through Spanish courts.

  • Other home insurance guarantees mainly apply within Spain.

Personal liability claims under your home insurance policy must be submitted through Spanish courts for the following reasons:

  • The policy is governed by Spanish law

  • The insurer is established in Spain

  • The insured risk is located in Spain

  • Jurisdiction clause in the policy

  • EU coverage does not change jurisdiction

What is not covered by personal liability insurance?

Personal liability does not cover:

  • Damages caused intentionally or through gross negligence.

  • Claims arising from professional, business, agricultural or commercial activities.

  • Damages related to the use of motor vehicles, which must be insured separately.

  • Fines, penalties, or sanctions imposed by authorities.

  • Certain extraordinary events or exclusions listed in the General Conditions.

Personal Liability coverage is not legally mandatory in most cases, but it is strongly recommended, as claims from third parties can be costly and unexpected.
